Return and Refund procedure for the www.bakuhatsu.eu online store

I. Preliminary provisions

1. This Complaint Procedure regulates the procedure for exercising rights arising from defective performance (hereinafter referred to as the "complaint") between the company Bakuhatsu s.r.o., Company ID No.: 54442010, with its registered office at Jána Náhlika 2620/14, 905 01 Senica, Slovesnko, registered in the Commercial Register maintained at the District Court in Trnava, Section Sro, File No. 50996/T (hereinafter referred to as the "Seller"), and the Buyers who are consumers (hereinafter referred to as the "Buyer").
2. The Complaints Procedure is an integral part of the Seller's General Terms and Conditions and is publicly available on the https://www.bakuhatsu.eu/articles/terms-and-conditions/ website.

II. Liability for defects and warranty conditions

1. The seller is responsible for defects that the sold goods have when they are taken over by the buyer.
2. The warranty period is 24 months from the date of receipt of the goods, unless otherwise stated for specific goods.
3. Liability for defects does not apply to:
• defects caused by mechanical damage to the goods,
• defects caused by improper use or maintenance contrary to the instructions for use,
• defects resulting from normal wear and tear;
• defects caused by the intervention of the buyer or a third party.

III. Procedure for filing a complaint

1. The buyer is obliged to file a complaint without undue delay after discovering a defect in the goods.
2. The buyer can make a complaint:
• by sending the goods together with a description of the defect and proof of purchase to the seller's address.
3. The complaint will be settled without undue delay, no later than 30 days from the date of its application, unless the seller and the buyer agree otherwise.

IV. Right of withdrawal within 31 days

1. The Buyer has the right to withdraw from the distance contract without giving a reason within 31 days from the date of receipt of the goods.
2. To exercise the right of withdrawal, the Buyer must inform the Seller of its decision to withdraw from the contract by means of an unambiguous statement (e.g. a letter sent by post or e-mail) to the address store@bakuhatsu.eu.
3. The withdrawal period is maintained if the buyer sends a notice of exercise of the right of withdrawal before the expiry of the 31-day period.
4. After withdrawing from the contract, the buyer is obliged to send the goods back to the seller's address without undue delay, no later than 31 days from the date of withdrawal from the contract.
5. The direct cost of returning the goods is borne by the buyer.
6. The Seller shall refund to the Buyer all payments received from the Buyer, including delivery costs (except for additional costs incurred as a result of the chosen delivery method, which is different from the cheapest conventional delivery method offered by the Seller), without undue delay, no later than 14 days from the date on which the Buyer was informed of the Buyer's decision to withdraw from the contract.
7. The seller is not obliged to refund payments to the buyer before the goods are delivered to him or until the buyer proves that the goods have been sent back to the seller.
8. The buyer is responsible for the decrease in the value of the goods that has arisen as a result of the handling of the goods
